Corría finales de año 2003, cuando se produjo una de las, modificaciones mas importantes del código civil en cuanto a los derechos que los abuelos tienen sobre sus nietos. Este cambio sustancial se produjo con la Ley 42/2003, de 21 de noviembre, de modificación del Código Civil y de la Ley de Enjuiciamiento Civil en materia de relaciones familiares de los nietos con los abuelos, el ultimo fin perseguía como objetivo reforzar el régimen de las relaciones entre abuelos y los nietos, tanto en caso de ruptura familiar, es decir separación o divorcios, como en el caso de dejación de obligaciones por parte de los progenitores, cuando estos no cumplen el régimen de visitas .
Motivación para la modificación de la “Ley de los abuelos”
“Los abuelos desempeñan un papel fundamental de cohesión y transmisión de valores en la familia, que es el agente de solidaridad por excelencia de la sociedad civil. Los poderes públicos han de fomentar la protección integral del menor y de la familia en cumplimiento del mandato constitucional del artículo 39…”
Así las cosa y partiendo de que la Constitución siempre va garantizar la protección integral del menor y de la familia, en donde se incluyen a todos sus miembros, padres, hijos y abuelos, parece claro que, aunque existan conflictos de intereses y dificultades entre las personas, deberíamos poner todos los medios posibles a nuestro alcance para que la relación “abuelo-nieto” sea lo más fluida posible, y no se tenga que acudir a los tribunales para que se reconozca algo tan básico como que un abuelo quiera y pueda ver a su nieto.
El artículo 160 del Código Civil dispone que:
“No podrán impedirse sin justa causa las relaciones personales del hijo con sus abuelos y otros parientes y allegados. En caso de oposición, el Juez, a petición del menor, abuelos, parientes o allegados, resolverá atendidas las circunstancias. Especialmente deberá asegurar que las medidas que se puedan fijar para favorecer las relaciones entre abuelos y nietos, no faculten la infracción de las resoluciones judiciales que restrinjan o suspendan las relaciones de los menores con alguno de sus progenitores”.
Todas las decisiones que se adopten deberán ser siempre “en interés del menor” y no se podrá impedir “sin justa causa” las relaciones de los nietos con sus abuelos, y ello bajó el manto protector de la justicia que establecerá lo más conveniente para dicho fomento y sin conculcar derechos.
Pero ¿qué se entiende por justa causa? Y ¿quién debe probar la existencia de la misma?
Algunos piensan que “justa causa” sería que la relación de los abuelos con los nietos fuera perjudicial para los menores, al poner en peligro su salud, su seguridad, su formación, educación, etc, o incluso que ejercieran “mala influencia” sobre ellos, por eso es tan importante la prueba de que esto sea así.
La carga de la prueba de la existencia de “justa causa” corresponderá a los padres que se oponen al ejercicio del derecho, por lo que existe una presunción favorable al mantenimiento de las relaciones entre abuelos y nietos desde la perspectiva del interés del menor.
La Jurisprudencia del Tribunal Supremo ha declarado reiteradamente que no son “justas causas” las rencillas personales o la existencia de malas relaciones entre progenitores o alguno de ellos con los abuelos, sirva de ejemplo la STS 689/2011, de 20 de octubre, donde se dice que:
“…. El art. 160.2 CC, a contrario sensu, permite denegar las relaciones del nieto con sus abuelos cuando concurra justa causa, que no define y que debe examinarse en cada uno de los casos que se deban enjuiciar. Y la sentencia recurrida ha considerado justa causa el enfrentamiento entre el padre de los menores cuya visita se demanda, con la abuela, su madre, lo que podría “repercutir en la integridad psicológica del menor”, es decir, que la hostilidad entre los litigantes es tal que el contacto entre el nieto y la abuela recurrente podría hipotéticamente, ser contraria al interés del menor debido al alto grado de enfrentamiento entre los ascendientes y el posible perjuicio que podría producir.
Esta Sala….. sí puede valorar si la causa justificadora de la negativa al reconocimiento del derecho de visitas de la abuela recurrente es constitutiva o no de justa causa para eliminar este derecho. Y a la vista de ello, debe concluirse que en la valoración de los hechos probados, la sentencia recurrida ha tenido en cuenta, no el interés del menor, sino el del padre de los menores. Para llegar a esta conclusión debe utilizarse nuestra jurisprudencia más reciente. Así, por ejemplo, la STS 576/2009, de 27 de junio, decía “Que las relaciones entre el padre y los parientes de su mujer no deben influir en la concesión del régimen de visitas” y la STS 858/2002, de 20 de septiembre, que consideró que no constituía justa causa para la denegación de las visitas de los abuelos a los nietos la animadversión del padre hacia la familia de la madre ya fallecida, ni la influencia hipotética que los abuelos pudieran tener sobre sus nietos. Por todo lo anterior, hay que concluir que en la sentencia recurrida no se ha tenido en cuenta lo que constituye el verdadero núcleo de la cuestión, es decir, el interés del menor, porque la causa alegada solo de manera indirecta e hipotética puede afectar a los menores. Procede, en consecuencia, reconocer el derecho del nieto a relacionarse con su abuela, ahora recurrente.
Conclusión de la Ley de los Abuelos
Se autoriza el derecho de visitas y se establece la posibilidad de suspensión o limitación del régimen de visitas cuando se observe a juicio del juez, un perjuicio al menor.”
A los abuelos a los que antes no les quedaba más remedio que resignarse y aguantarse ante la negativa de ver a sus nietos ahora pueden reclamar en los Tribunales su derecho de visitas (mediante demanda en juicio verbal), según recoge el artículo 250.1.13º de la LEC y así ejercer una de las mayores satisfacciones que tienen: el poder ver a sus nietos.
